Essential Patents (SEPs) in the Brazilian Judiciary: Infringement, Validity, and FRAND Licensing

This article aims to analyze disputes involving standard-essential patents (SEPs) in Brazil, with a particular focus on judicial disputes concerning patent infringement, essentiality, and validity. To this end, the study initially explores the definition of SEPs, the role of standard-setting organizations, and licensing under FRAND (Fair, Reasonable and Non-Discriminatory) terms. The article then examines litigation statistics before both Federal and State Courts. Finally, it addresses topics that contribute to Brazil’s strategic role within the global ecosystem of standard-essential patentes, as the requirements for granting preliminary injunctive relief and the appropriate timing for expert evidence, as well as analize the territorial scope of judicial decisions in disputes involving the determination of FRAND terms.
