Constitutional jurisdiction as an arena for the realization of Honnethian social freedom?

Abstract

The aim of this study is to analyze the possibility of realizing social freedom in the sphere of Law, despite Axel Honneth’s criticisms of theories of justice built from this paradigm. It starts with an examination of the crisis of the constitutional democratic State from the perspective of a supposed kidnapping of the public will in the new communicative spheres, especially from the advent of social network platforms, to, in a second moment, analyze the role of constitutionalism and the institutional possibilities of realizing Honneth’s social freedom in the political space of constitutional jurisdiction and its role in the recognition of minority groups.
