Digital sovereignty: legitimacy and effectiveness of law enforcement on the internet
Abstract
How to ensure, in a legitimate way, the effectiveness of law and court orders in the digital environment? Based on this question and on the analysis of recent cases in international jurisprudence, the article presents legitimacy standards that may conduct the decision-making process and provide a minimum degree of predictability and objectivity to state authorities’ regulatory actions on the internet.
