From orthodoxy to criticism: theories of legal comparison

Abstract


The present article has two main objectives that are interconnected and concomitant. The first one is to explain the fundamental importance of the Theory of Legal Comparison, as an autonomous and essential field of studies that compose Comparative Law, paradoxically little explored in the national legal literature. To achieve this result, the dialogue between two of the main contributions developed by scholars in this field was highlighted and analyzed in a detained way. The orthodox and critical schools, through their main exponents, dedicate their intellectual efforts to produce a reflection on the production of comparative legal knowledge. The crucial contributions brought by these intelligences are, in turn, the second and last objective of this study.
