Migrant workers in the international legal environment
between protective norms and discriminatory practices

The article analyses the main international norms that provide for the protection of migrant workers and seeks to identify the obstacles that have been preventing their proper implementation. It seeks to verify which factors prevent the proper functioning of the mechanisms provided for in international treaties to enforce the rights of migrant workers and which factors are behind the omissions of national States in complying with international standards and monitoring working conditions. To this end, it begins with an analysis of discrimination in national legislation and its share of responsibility for the situation of vulnerability faced by migrant workers today. The research was developed using a qualitative approach and a deductive method, with a bibliographical review, starting from general questions to arrive at particular conclusions. It is concluded that political-economic factors have been corroding important institutions and legal mechanisms in the domestic and international spheres, creating an abyss between international protective norms and national policies and practices.
