Trabalhadores migrantes no ambiente jurídico internacionalizado
entre normas protetivas e práticas discriminatórias

O artigo analisa as principais normas internacionais que preveem proteção aos trabalhadores migrantes e procura identificar quais são os obstáculos que vêm impedindo a sua devida efetivação. Busca-se identificar quais fatores impedem o funcionamento adequado dos mecanismos previstos nos tratados internacionais para efetivação dos direitos dos trabalhadores migrantes e quais fatores se encontram por trás das omissões dos Estados nacionais no cumprimento das normas internacionais e na fiscalização das condições de trabalho. Para tanto, inicia-se com uma análise das discriminações constantes nas legislações nacionais e da sua parcela de responsabilidade pela situação de vulnerabilidade enfrentada pelos trabalhadores migrantes na atualidade. A pesquisa foi desenvolvida com a utilização de abordagem qualitativa e método dedutivo, com revisão bibliográfica, partindo de questões gerais para se chegar em conclusões particulares. Conclui-se que fatores político-econômicos vêm corroendo importantes instituições e mecanismos jurídicos nos âmbitos interno e internacional, criando um abismo entre as normas protetivas internacionais e as políticas e práticas nacionais.
