Artificial Intelligence, emotion recognition technologies, and law: the importance of the principle of data quality as a pillar of the fundamental right to data protection

Abstract


This article analyzes emotion recognition technologies (ERTs) from a legal perspective and through qualitative research. We analyzed the collection of such data from an ethical, constitutional, and legal point of view. We present the principle of data quality to explain the legal consequences of indiscriminate use of ERTs. The research revealed that the problems identified in facial recognition technologies in general are common to ERTs. Besides those problems, ERTs faces the challenge related to the subjectivity present in the data processing. We conclude that as a fundamental right, the protection of emotional data requires specific legislative attention.
