Constitucionalismo digital e jurisdição constitucional: uma agenda de pesquisa para o caso brasileiro

Resumo


O artigo discute como princípios atribuídos ao Constitucionalismo Digital podem influenciar o controle de constitucionalidade de legislações como o Marco Civil da Internet. O texto sustenta que uma transformação teórica da jurisdição constitucional brasileira voltada à proteção de direitos fundamentais no ciberespaço requer (i) a redefinição da perspectiva tradicional de teoria da eficácia horizontal dos direitos fundamentais e ainda (ii) a abertura do controle de constitucionalidade à compreensão do fenômeno de re-territorialização da internet. Essas possibilidades são examinadas a partir das discussões acerca da responsabilidade dos intermediários on-line e da obtenção judicial de dados digitais por acordos MLAT.
