O presente artigo tem como objeto a estrutura legal da mediação em Portugal. Coloca-se a pergunta sobre a necessidade ou não de regulamentar-se legalmente a mediação.

ABSTRACT:
The mediation regulatory task is complex due to it flexibility in terms of procedures and instruments. In this paper we intend to analyze the balance between the mediation flexibility and the necessary uniformity, taking into account the worldwide different mediation regulatory models. Following the international regulation trend on this matter, Portugal has approved a general Mediation Law, which main principles and rules we analyze in this paper.
